We are registered in Hong Kong under company number 1039942 with our registered office at Block A-B, 2/f., Wui Wah Factory Bldg., 1035 Yee Kuk West Street, Kowloon, Hong Kong. The services are made available to you pursuant to the following Terms of Use & Service and any other rules posted on our Sites. Please read the Terms & Conditions carefully before placing any orders on our Site. 

In particular, we wish to draw your attention to our policies relating to the terms of purchase within the Terms & Conditions. If you are under 18, you must let your parent or guardian know about Daydream Nation's Terms & Conditions before you register to use this Site or any of this Site's services. We reserve the right to only accept orders from those over 18 however.

We have the right to revise and amend the Terms & Conditions from time to time. You will be subject to the Terms & Conditions in force at the time when you order products from us, unless any change to the Terms & Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you). If you do not agree to any changes to the Terms & Conditions, you should then immediately stop using the Site.

 

REGISTRATION

To use some of the services or features made available to you on this Site, you may need to get registered. When you get registered, you are required to provide your personal information (“Personal Information”) that is true, accurate, current and complete in all respects. Any Personal Information given to our Site will be protected and will not be disclosed to any third parties. DAYDREAM-NATION.CO.UK server will secure your Personal Information with up-to-date firewall and encryption techniques during the ordering process.

ELIGIBILITY TO PURCHASE 

In order to make purchases through the Site, you will be requested to register at PayPal™ (https://www.paypal.com/) and provide your personal details. In particular, Customers must provide their real name, telephone number, e-mail address and other information as indicated. Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Site's e-shop is available only to individuals and others who meet the terms of eligibility of both DAYDREAM-NATION.CO.UK and PayPal™, who have been issued a valid credit card by a bank acceptable to PayPal™, whose applications are acceptable to PayPal™ and who have authorised PayPal™ to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase. Daydream Nation reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

By making an offer to purchase merchandise, you expressly authorise us to perform credit checks and, where Daydream Nation feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit-card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

 

ORDERS AND PRICING POLICY

DAYDREAM-NATION.CO.UK offers products for sale that are in stock and available for dispatch. All orders are subject to acceptance and availability. In the event that an ordered item is out of stock, the customer shall receive an e-mail notification and be entitled to a full refund via PayPal™ within 48 hours.

Prices shown on the Site are in US Dollars ("USD") and are exclusive of tax.  

All prices and offers remain valid as quoted on our Site from time to time.

Customers purchasing from Hong Kong will be offered free local delivery service and be charged for the items purchased only.

Customers purchasing from a foreign country will be charged for the items purchased together with the necessary shipping costs.

Daydream Nation cannot determine in advance the amount of customs charges, taxed or duties, if any, that will be charged. You are advised to check with your local customs to ascertain if any additional charges will be applied to your order prior to purchase completion. In the event that you refuse to pay customs charges on an incoming shipment, Daydream Nation will reserve the right to offset any such customs charges paid from the refund of the original purchase price to the Customer.

If you are a customer whose credit card is not denominated in USD, the final price will be calculated in accordance with the applicable exchange rate on the day your credit card company processes the transaction.

 

ACCEPTANCE OF YOUR ORDER

Once your order has been placed, you will receive an email acknowledging the details of your order. This email is just a confirmation on receipt of your order and shall NOT be deemed an acceptance of it.

Once an order has been placed, no modifications to the order including cancellations are allowed. Acceptance of your order and completion of the contract between you and DAYDREAM-NATION.CO.UK will be completed when we email you to confirm the goods have been dispatched (“Dispatch Confirmation”).   

We reserve the right not to accept your order in the event that we are unable to receive payment, that shipping restrictions apply to a particular item ordered, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria as set out in the Terms & Conditions.

We may also refuse to process and accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold; removing, screening or editing any materials or content on the Site; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

 

PAYMENT

Payment can be made via PayPal™ and/or any other methods which may be clearly advertised on the Site from time to time. Payment will be debited and cleared from your account upon placement of an order and before dispatch of your order by DAYDREAM-NATION.CO.UK. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it for such order. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. We will not be liable for any delay or non-delivery of the item(s) ordered by reason of any refusal and/or failure of such validation checks and authorization by the card issuer PayPal™.

 

DELIVERY

Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation. The Products will be at your risk from the time of delivery.

Ownership of the item ordered will only pass to you when we receive full payment of all sums due in respect of the item ordered, including all necessary charges.

Please note that we aim to dispatch all orders within 96 hours. Estimated delivery times are to be used as a guide only and the actual delivery times depend on destinations of delivery and commence from the date of dispatch. DAYDREAM-NATION.CO.UK is not responsible for any delay caused by destination customs clearance processes.

 

TRACKING YOUR ORDER

You can always check your order status by signing into your account and selecting the option "order status/history" to check if your order has been fulfilled, shipped, or if it is being held. You will also be able to track the shipment status by typing in your unique tracking number at the carrier’s website which we will email to you.

 

RETURNS AND EXCHANGES POLICY

Sales of all products are final, non-refundable and non-returnable once order is placed and payments have been received. All associated shipping costs, including taxes or duty, are non-refundable.

We may include hyperlinks on this Site to other websites or resources operated by parties other than DAYDREAM-NATION.CO.UK, including advertisers. DAYDREAM-NATION.CO.UK has not reviewed all of the sites linked to its Web Site and is not responsible for the content or accuracy of any off-site pages nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.

 

OUR LIABILITY

Our liability for losses you suffer as a result of us breaking the Terms & Conditions is strictly limited to the purchase price of the item you ordered and any losses which are a reasonably foreseeable consequence of us breaking the Terms & Conditions. Losses are reasonably foreseeable where they could be contemplated by you and us at the time when your order is accepted by us.

This does not include or limit in any way our liability:

(a)   For death or personal injury caused by our negligence;

(b)   For fraud or fraudulent misrepresentation; or

(c)   For any deliberate breaches of these Terms by us that would entitle you to terminate the contract between us;

(d)   For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us and even if such losses result from a deliberate breach of these Terms by us that would entitle you to terminate the contract between us, including but not limited to:

(a)     loss of income or revenue

(b)     loss of business

(c)     loss of profits or contracts

(d)     loss of anticipated savings

(e)     loss of data

(f)       waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise [even if foreseeable];

DAYDREAM-NATION.CO.UK shall not be responsible for failure to meet any of its obligations under the Terms & Conditions where such failure is due to events beyond its reasonable control as more particularly detailed hereunder.

EVENTS OUTSIDE CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event). 

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

(a)   Strikes, lock-outs or other industrial action.

(b)   Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

(c)   Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.

(d)   Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

(e)   Impossibility of the use of public or private telecommunications networks.

(f)     The acts, decrees, legislation, regulations or restrictions of any government.

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

 

OUR RELATIONSHIP

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and DAYDREAM-NATION.CO.UK as a result of the Terms & Conditions or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of DAYDREAM-NATION.CO.UK, and we shall not be liable for any representation, act, or omission on your part.

 

NO WAIVER

If we fail at any time to insist upon strict performance of any of your obligations under the contract for purchase of any item or any of these Terms & Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract for purchase of any item, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing whether by way of e-mail and/or postal address you provide to us when placing an order. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

 

GOVERNING LAW

The Terms & Conditions together with all our policies and procedures will be governed by and construed in accordance the relevant HKSAR law and the relevant courts of the HKSAR will have exclusive jurisdiction.
